DSPN Investment in Adult Family Home Providers

Current Updates:

In early March, we were provided with a status update on this potential code revision.

  • Currently, DHS is finalizing the proposed rule order and economic impact analysis.

  • Then, the proposed rule order and economic impact analysis will go through a period of external reviews.

  • The Legislative Council will review.

  • Then, DHS will hold an agency public hearing and public comment period.

  • Next, DHS will conduct a final agency review. This will include responding to any feedback from Legislative Council and the public and submission to the Governor’s office for approval.

  • Then, it will go to the legislature for the legislative review process.

  • Finally, the rule would be published by the Legislative Reference Bureau.

As 3-4 Adult Family Home Providers are aware, DHS solicited comments on the economic impact of the current proposed rule. We thank the provider community for taking the time to submit commentary to the Department.

In addition, DSPN submitted comments driven by abundant member feedback and input. We're appreciative of all those that took the time to offer insightful concerns and observations.

Background:

 

The Wisconsin Department of Health Services (DHS) has received approval from the Governor to create, amend, or repeal administrative rules. The objectives of the rulemaking are defined the Statement of Scope.

Statement of Scope: Revised Statement of Scope SS 066-24, Governor's approval 5/30/24. This revised statement of scope modifies SS 108-21, which was published in Register No. 792A1 on December 6, 2021.

Wis. Admin. Code Chapter. DHS 88 Economic Impact Comment Period Closed September 12th.​

'As part of the Division’s commitment to Teach, Learn, and Collaborate, the Division of Quality Assurance (DQA) requested comments on the economic impact of draft proposed rule, Wis. Admin. Code ch. DHS 88, relating to 3-4 bed licensed adult family homes. Licensed adult family homes provide care, treatment, or services to three or four adults that are above the level of room and board, including up to seven hours per week of nursing care per resident.

We have solicited information and input from individuals, businesses, associations representing businesses, local governmental units, and others who may be affected by the proposed rule for use in analyzing and determining the economic impact that the rule would have on businesses, individuals, and others.'
